Appearing before the WSIB and the WSIAT requires more than familiarity with workers’ compensation legislation and policy; it requires strategic thinking, careful preparation, and effective advocacy. In this workshop, experienced advocates will guide participants through the key stages of a successful appeal, highlighting both procedural requirements and advocacy best practices.
Topics will include:
- Appealing a board-level decision within mandated timelines;
- Identifying, sorting, and prioritizing issues in an appeal;
- Developing a persuasive “theory of the case”;
- Meeting pre-hearing disclosure obligations;
- Obtaining and organizing relevant evidence;
- Anticipating and responding to the other side’s arguments;
- Preparing clients for hearings;
- Effectively using and challenging medical information;
- Making compelling opening statements and final arguments; and
- Questioning and cross-questioning witnesses.
