SUMMARY:Waivers in Sports and Recreational Activities: Current Law & Emerging Issues
DESCRIPTION:If you’re a member of a fitness club or a recreational sports league\, or have a school-aged child\, liability waivers are a fact of life. Questions about the validity and enforceability of waivers are common\, both from activity operators seeking to protect themselves from negligence claims and from patrons who signed a waiver and were subsequently injured. Challenges to waivers\, and the defence of claims involving the interpretation of waivers\, require careful analysis of a number of variables. \nThis webinar features Ryan Morasiewicz\, experienced outdoor/adventure and personal injury litigator\, as well as a mountain Search and Rescue volunteer. Ryan will introduce general practitioners\, corporate counsel\, and other non-personal injury specialists to this discrete area. Topics include the insurance context in which a liability waiver operates\, requirements of a valid waiver (both style/substance and administration)\, challenges to enforceability or validity of waivers\, and the special case of minors and related consent acknowledgement of risk forms. Ryan will provide a broad perspective of relevant cases and statutes across Canada. \nYou’ll leave with a better understanding of the purpose of waivers\, what participants are being asked to give up when they sign a waiver\, and tools available to recreational providers to insulate themselves from and defend personal injury claims. Attend this course and help your clients better manage the legal risks that are part of their everyday lives. \nLive webinar with chat includes 60 day replay. This program features real-time video of the presenter with synchronized presentation slides\, and a chat feature that allows for live Q & A.

SUMMARY:Beyond the Brief: Fiction\, Creativity & Storytelling for Lawyers
DESCRIPTION:A Special Presentation for Lawyers\, Readers & Aspiring Writers\nWhy do so many lawyers become successful novelists? \nLawyers work with story every day: shaping narrative\, analyzing motive and conflict\, uncovering revealing details\, and persuading through language. It is perhaps no surprise\, then\, that many lawyers are drawn to storytelling in another form. \nIn this exclusive engagement\, lawyer and New York Times bestselling novelist William Bernhardt explores the unique relationship between legal thinking and the writer’s craft. Through discussion\, examples\, and reflections from his own career\, Bernhardt offers a behind-the-scenes look at storytelling itself—from character and dialogue to suspense\, structure\, pacing\, and the realities of writing and publishing fiction today. \nPart conversation and part storytelling masterclass\, this rare presentation offers a refreshing departure from traditional continuing legal education programming. \nWhether you have considered writing yourself\, are curious about the publishing world\, or simply want to explore the connection between law\, creativity\, and imagination\, this one-of-a-kind presentation promises an engaging\, thoughtful\, and entertaining break in your day. \nStep away from precedents and practice pressures—and into the world of storytelling. \nEnrolment is limited. Early registration is encouraged. \nLive webinar with chat includes 60 day replay. This program features real-time video of the presenter with synchronized presentation slides\, and a chat feature that allows for live Q & A.

SUMMARY:Lancaster’s Workplace Essentials: Off-Duty Conduct
DESCRIPTION:As social media usage has grown\, the off-duty conduct of employees is more conspicuous than ever. In this installment of Lancaster’s Workplace Essentials webinar series\, panelists will provide attendees with a guideline to key principles pertaining to off-duty conduct and associated discipline. Questions to be discussed include: \n\nWhat is encompassed by off-duty conduct? What factors do decision-makers consider in determining if the off-duty conduct in question is work-related?\nWhat lessons can be learned from recent decisions in which decision-makers have addressed whether an employer was correct to discipline or dismiss an employee due to off-duty conduct?\nIn what circumstances have arbitrators found an employer’s decision to discipline or dismiss an employee due to inappropriate social media posts justified? Not justified?\nWhen will employers be required to investigate violence or harassment that occurred off duty? Could employers face liability for failing to investigate in these circumstances?\nHow should employers and unions handle incidents where employees or members have been charged with a criminal offence? Can an employer suspend an employee without pay pending the outcome of the charges?\nWhen can an employer dismiss an employee who has been convicted of a criminal offence? Is a connection between the offence and the employee’s duties required for the dismissal to be justified?\nWhat aspects of off-duty conduct have been specifically addressed in workplace policies or collective agreement provisions?
