Objections based on Crown Immunity and Confidential Informant Privilege

The Crown continues to enjoy certain privileges and immunities against compelled testimony, discovery examination and pre-trial production of documents, in addition to privileges or immunities that are enjoyed by all private persons or entities. While Crown privileges and immunities may be removed by an act of a Legislature or Parliament, they remain important considerations in civil litigation, whether the Crown is a party or a non-party custodian of evidence.
