Business Methods and Patentable Subject Matter: Canada (A.G) v. Amazon.com, Inc., Fed CA

Panelists

  • Brian Gray, Norton Rose LLP
  • Etienne de Villiers, Dimock Stratton LLP
  • Norman Siebrasse, UNB Faculty of Law

Moderator

  • Christine Pallotta, Borden Ladner Gervais LLP

Patent lawyers and agents have been eagerly anticipating the court’s response on the sometimes vexing issue of patenting business methods in Canada.  The battle over Amazon.com’s patent application for a “one-click” internet purchase method has led to the most significant Canadian decision since Schlumberger to address the issue of patentable subject matter  in cases of computer implemented methods.  Dial into this seminar to have an expert panel explain the context and implications of this critical patent case.  Find out:

  • The aspects of the patent claim that were at issue
  • The aspects of the trial level analysis expressly upheld or rejected by the appeal court
  • What we now know – and don’t know – about the patentability of business methods
  • The role of a “physicality requirement” in these types of applications
  • What principles can we now say will be applied to construction and adjudication of this type of claim?  Is there a clear (or even unclear) test?
  • Distinguishing subject matter exclusions from the rule against abstract claims
  • What are some key unanswered questions in the wake of these proceedings?
  • The U.S. experience – how we compare now.  Does the US jurisprudence and experience provide helpful guidance going forward?
  • Suggestions for drafting business method patent applications in light of the recent developments

Participants will also have opportunities to ask questions of the panel.
